Terms and Conditions for Naturewalk

1. Scope and contracting party
These Terms apply to all contracts for the digital product "Naturewalk" between Visenza LLC, 2165 Van Buren St, Suite 911, Hollywood, FL 33020, USA ("Visenza") and consumers who purchase Naturewalk via naturewalk.visenza.co.
2. Scope of services
Naturewalk is a digital experience accessed online in the membership area after purchase. It consists of consecutive chapters with videos, images, sound and text elements, along with accompanying questions and a questionnaire. The chapters are experienced in sequence.
Naturewalk is a one-time purchase. No subscription is created, there is no automatic renewal and no recurring payment.
The scope follows from the product page as published at the time of purchase. Visenza may replace individual pieces of content with equivalent ones or add to them, as long as the character and overall scope of the experience are preserved.
3. Conclusion of contract
The contract is concluded once you confirm the purchase and payment has been successfully processed via CCBill. Payment is processed exclusively via CCBill. Visenza does not receive full payment data. After purchase you receive a confirmation by e-mail and access to the membership area.
4. Price and payment
Naturewalk costs EUR 149 as a one-time payment. The price is a final consumer price and includes the value added tax of the country in which you are habitually resident. Visenza remits that value added tax in the buyer's respective country. The price shown on the product page at the time of purchase applies. Payment is due upon conclusion of the contract and is processed via CCBill. The billing name agreed with CCBill (billing descriptor) appears on your statement.
5. Duration of access
Access to Naturewalk is unlimited in time. After purchase you may access the experience as often as you like with no expiry date, for as long as your access exists and the product is operated.
Should Visenza discontinue the operation of Naturewalk, this will be announced in text form at least three months in advance to the e-mail address you provided.
6. Access, account and login
Access is tied to the e-mail address you provide at purchase. Login works via a sign-in link sent to that address. Please keep your e-mail address current and notify us of any change so that your access is preserved.
7. Personal, non-transferable access
Naturewalk is intended solely for the purchasing individual. Sharing access credentials or sign-in links with third parties is not permitted.
8. Rights of use
You receive a simple, non-transferable right to access the content for private purposes. All content, in particular videos, images, sound and text, is protected by copyright. Recording, downloading, copying, making publicly available, passing on or otherwise distributing all or part of it is not permitted without Visenza's prior written consent.
9. Age restriction and artistic depiction
Naturewalk is intended exclusively for individuals aged 18 and over. Naturewalk contains artistic footage of nature and the body in which nudity occurs. The content is neither pornographic nor sexualized. Before access, you confirm via a separate checkbox that you are at least 18 years old and that you have been informed about this kind of depiction. The time of this confirmation is stored.
10. Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal, inform us by an unambiguous statement, for example by e-mail to christina (at) visenza (punkt) co, of your decision to withdraw from this contract. To meet the deadline, it is sufficient that you send your notice before the withdrawal period expires.
Early expiry of the right of withdrawal
Your right of withdrawal expires early once we have begun providing Naturewalk, provided that you have
- expressly agreed that we begin delivery before the withdrawal period expires, and
- confirmed that you thereby lose your right of withdrawal.
We obtain this consent and confirmation before the purchase is completed, via a separate checkbox that is not pre-ticked. A purchase is not possible without this consent.
In practice this means: as soon as you access Naturewalk after purchase, you lose your right of withdrawal. Until that point, you may withdraw at any time without giving reasons.
Effects of withdrawal
If you withdraw in time, meaning before you have begun accessing the content, we will reimburse all payments received from you without undue delay and at the latest within fourteen days of receiving your notice. We will use the same means of payment as in the original transaction unless expressly agreed otherwise.
11. Technical requirements and availability
To use Naturewalk you need an internet-capable device, a current browser and a stable internet connection. Naturewalk is designed for use on a mobile phone and can also be accessed on a computer. Visenza strives for high availability but does not owe uninterrupted access. Short interruptions due to maintenance, updates or disruptions at service providers are possible.
12. No medical or therapeutic advice
The content of Naturewalk serves personal experience and self-reflection. It does not replace medical, psychological or therapeutic advice, diagnosis or treatment. No specific outcome is promised. If you are undergoing treatment or have health concerns, please consult a professional beforehand.
13. Liability
Visenza is liable without limitation for intent and gross negligence and under the mandatory provisions of applicable product liability law. Otherwise, Visenza is liable only for breach of material contractual obligations, limited to foreseeable, typical damage. Liability for injury to life, body or health remains unaffected.
14. Governing law and consumer protection
The law of the State of Florida, USA applies, without prejudice to the mandatory consumer-protection provisions of the law of the country in which you are habitually resident, to the extent these cannot be waived under applicable private international law.
15. Changes to these Terms
Visenza may amend these Terms with future effect. The version published at the time your contract was concluded applies to your purchase.
16. Final provisions
Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
